Capital Square Privacy Policy

1. Legal Requirement to Disclose

Capital Square may disclose your information, including personal information, if we reasonably believe that disclosure:

• Is necessary to comply with a legal process (such as a court order, subpoena, search warrant, etc.) or other legal requirements of any governmental authority.
• Would potentially mitigate our liability in an actual or potential lawsuit.

2. Copyright Policy

Capital Square respects the intellectual property of others. Capital Square may, in appropriate circumstances and at its discretion, terminate the account or access of users who infringe the intellectual property rights of others.

3. Limited Licence

Capital Square grants the user a limited, nonexclusive, revocable right to use the building's application and digital platforms, provided that the user does not copy, modify, create a derivative work of, reverse engineer, or otherwise attempt to discover any source code thereof. Use is contingent upon full compliance with all terms of this Agreement.

4. Indemnification

User shall defend, indemnify, and hold Capital Square, its affiliates, and its officers, directors, employees, and agents harmless from any losses, damages, suits, or expenses (including reasonable attorneys' fees) arising out of:

• Any breach of agreement by the User.
• User's refusal to pay for services provided by Capital Square.
• User's use of the Capital Square Platform or Site.

5. Username and Password Security

When you create an account with Capital Square, you will provide a username, email address, and password.

• Responsibility: You are entirely responsible for maintaining the confidentiality of your credentials.
• Liability: Capital Square is not liable for losses incurred due to unauthorized use of your account. However, you may be held liable for losses incurred by Capital Square due to such unauthorized use.
• Security Recommendation: Capital Square encourages users to change their passwords at least once a month.

6. Information Collection and Use

Capital Square is the sole owner of the information collected on this application.

• Purpose: We collect and process information specifically for the purposes for which it was gathered (e.g., building access, facility booking, and security).
• Registration: To utilize Capital Square digital services, users must first complete the registration form.
• Data Usage: We may use IP addresses and usage patterns to analyze trends, administer the site, and improve the user experience.
• Note: Capital Square may retain correspondence (emails, letters, etc.) to ensure quality control and service excellence.

7. Third-Party Sharing

• Statistics: Capital Square may provide aggregate statistical information to third parties (such as advertisers or stakeholders). This data will not identify the User personally.
• Service Providers: We may partner with third parties to provide specific services (e.g., maintenance or concierge). We will share only the contact information necessary for the third party to provide these services.
• Business Transfers: Capital Square may transfer its database to a subsidiary, holding company, or surviving entity in the event of a merger or bankruptcy.

8. International Users

Users acknowledge that Capital Square is not responsible for the privacy policies or content of third-party international websites linked through our platform. Users are encouraged to read the privacy statements of any external site that collects personally identifiable information.

9. Modifications and Termination

Capital Square reserves the right to modify or discontinue services, temporarily or permanently, with or without notice.

• Service Continuity: Because services depend on hardware, software, and communication networks, Capital Square cannot guarantee that services will be uninterrupted, secure, or error-free.
• Account Termination: Capital Square may, at its sole discretion, terminate a user's participation and refuse future use of the platform.

10. Notices and Amendments

• Notices: Capital Square may provide notices regarding changes to this Agreement via the email address on record, regular mail, or by posting directly on the Site/Platform.
• Policy Changes: All modifications are effective upon posting. Continued use of Capital Square services after changes are posted constitutes acceptance of the new terms.

Miscellaneous: Nothing in this Agreement shall be construed as making either party a partner, joint venturer, or employee of the other. If any provision is held to be invalid by a court of law, the remaining provisions remain in full force and effect.
